Terms of use

These terms govern your use of Kentai Bonsai, a service provided by Hix Digital Ltd, registered at 20 Old Bond Street, Bath BA1 1BP, United Kingdom ("we", "us"). By creating an account or using the service you agree to them.

The service

Kentai Bonsai is a tool for recording and managing a bonsai collection, with optional AI-generated care guidance and a marketplace for buying and selling trees between users. We provide it on a best-effort basis but do not guarantee uninterrupted availability.

Your account

• You must be at least 16 years old to create an account.
• You are responsible for the security of your password and any activity on your account.
• One account per person. Don't impersonate someone else.

AI guidance disclaimer

The AI care summary is a software-generated suggestion based on the data we have about your collection and the local weather forecast. It is not a substitute for the judgement of an experienced grower or a horticulturist. Tree health depends on countless factors we cannot see (light levels, soil composition, root health, pest pressure). Use the summary as a prompt to think and look at your trees — never as a sole source of truth. We are not liable for the loss or damage of any tree as a result of following AI-generated advice.

Marketplace

Marketplace listings are user-generated. We don't inspect trees, verify sellers, or take part in the transaction. Buyers and sellers communicate directly by email. Any sale, payment, delivery and dispute is between buyer and seller; we are not a party to it. We reserve the right to remove listings that violate the law, common decency, or these terms.

Subscriptions

• The AI care summary is included free for 7 days from signup, then requires a subscription.
• Subscriptions auto-renew at the end of each period until cancelled.
• Cancel any time from the Billing page or via the Stripe customer portal. See our refund policy for what cancellation does and doesn't refund.
• We may adjust prices with at least 30 days' notice by email.

Acceptable use

• Don't upload photos that aren't yours, or that contain anything illegal, abusive or sexually explicit.
• Don't use the service to send spam or harass other users.
• Don't try to break, scrape, or reverse-engineer the service.
• Don't list stolen, fraudulent or illegally-collected trees on the marketplace.

We may suspend or terminate accounts that violate these rules.

Intellectual property

You keep ownership of everything you upload. By uploading you grant us a non-exclusive licence to display it back to you, generate AI summaries from it, and (for marketplace listings) show it publicly.

The Kentai Bonsai name, logo and software are owned by Hix Digital Ltd.

Liability

To the extent permitted by law, we are not liable for indirect or consequential losses, lost trees, lost data beyond reasonable backup recovery, or any damage caused by following AI-generated advice. Nothing in these terms limits our liability for death, personal injury, fraud, or anything else that cannot be limited under UK law.

Termination

You can delete your account at any time by emailing info@kentaibonsai.com. We can terminate accounts that violate these terms, with notice where reasonable.

Governing law

These terms are governed by the laws of England and Wales. Any dispute is subject to the exclusive jurisdiction of the English courts.

Changes

If we change these terms in a material way we'll email you. Continued use after the change means you accept it.
